Goals and Objectives

Actutor is a tutoring service dedicated to help students to get better grades, to do better in school, to achieve academic excellence, enjoy school, and eventually succeed in life.

 

Actutor is created based on the philosophy that success in life starts from success in school. Facts have shown that success in school will likely lead to success in life. The only way to do well in school is to love schooling.

 

Actutor provides tutoring to help each registered student not only to do well in each particular subject matter but also to help the student enjoy their education.

Services

Actutor enables students to connect with highly qualified independent contractor tutors who provide live, one-to-one instruction, tutoring and learning services in either real or virtual classrooms. If students and parents prefer face-to-face and real tutoring sessions, our tutors can meet with the student at an agreed-upon location. Alternatively, students can receive private tutoring in their own home at via our virtual classroom at their convenience.

 

Our service also includes, without limitation, carefully selecting tutors who best fit each student’s style and need. Afterward, we keep track of student’s favorite tutors so that learning and relationship can be fostered. Also, our service facilitates feedback from students so that we can continue to maintain excellent service.

 

Another essential service of Actutor is to require all tutors to pass stringent verification process to: (1) to confirm the validity of Tutors’ claimed educational credentials (2) to screen out suspicious history and (3) so select those who are matched with our philosophy of service.

 

Actutor is currently available 365 days a year.

 

Periodical website maintenance will be timely informed and make-up sessions will be provided so that no homework will be missed and no sessions will be lost.

 

Actutor is committed to provide excellent service to our students in accordance to our philosophy stated above.

 

Modifications to the Service

Actutor may add, change or eliminate features, pricing, nomenclature and other aspects of our services and make other changes at any time and these terms contained in this agreement will continue to apply to the services as modified. Actutor reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the site or the services or any part thereof with or without notice. Students agree that Actutor shall not be liable to them or to any third party for any such modification, suspension, or discontinuance of the site or the services.

 

Registration to Actutor

Students can register to an appropriate tutoring plan, online or in person, by using a valid credit card number. When students decide to use our service and choose a specific tutoring plan, Actutor will immediately charge the student’s credit card and put into the student’s account the number of hours and minutes that correspond to the student’s particular tutoring plan. The number of sessions Actutor places in each student’s account will remain in student’s account until the first tutoring session has finished. After tutoring sessions, students’ account balance statements will be provided so that he or she knows exactly the remaining balance on his or her account.

 

Students can elect to end or continue with his or her services after their account balance has been used up.

 

Refunds for unused sessions may only be made via request by email and within 90 calendar days from the original purchase date.

 

Actutor is committed to keep student’s information confidential, which is required by law.

 

Billing Structure. Actutor’’s rate is twenty dollars or more per hour, except for promotional periods where the rate is $15 per hour. Actutor shall provide accurate rate for purpose billings and accounting for each student.

 

Late payment. Actutor only enables each tutoring session based on payment approval of credit card. At the beginning or after the expiration of each student account, new credit payment is required for immediate continuation of the lessons. Thus, there is no grace period for late payment. Students are suggested to wait for the approval of credit payment to continue their lessons.

 

Interim charge caps. There is no interim charge cap for Actutor. Students may charge up to the amount of lessons they need, whatever this number of sessions maybe.

 

Student Conduct

To use Actutor tutoring services, students must be at least 18 years of age. Students who are younger than 13 years old must have parental approval in order to join our services.
In consideration of use to our services, each student agrees to:

(a) provide accurate, current, and complete information prompted by a registration form on the Actutor website;
(b) maintain their own security of password and identification;
(c) maintain and promptly update the registration data and/or any information provided to Actutor to keep it accurate, current and complete; and
(d) accept all risks of unauthorized access using student’s registration information such as username and password.

Students are entirely responsible for all content that they upload, post, or otherwise transmit through your use of Actutor service.
Furthermore, students agree not to upload, post or otherwise transmit any contents that:

(a) is inaccurate, harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, or otherwise objectionable to Actutor or other users of the website;
(b) includes unauthorized disclosure of personal information;
(c) violates or infringes anyone’s intellectual property rights; or
(d) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

Actutor reserves the right to remove any content that violates these Terms or that contains third-party commercial advertisements.

Termination

Actutor reserves the right to terminate service to any students by providing the student with notice of such termination, which shall be effective immediately upon delivery of such notice

 

Actutor may terminate services immediately cause and without notice for any breach by students of Actutor’s terms or any of our applicable policies, as posted on the site from time to time. On the other hand, students may terminate services any time for any reason. In any case, refunds of any balance will be forwarded to students.

 

In the event of termination or expiration of these terms, all provisions regarding ownership of intellectual property, indemnification, disclaimer of warranties and limitations of liability, consequences of improper conduct, fraud or abuse, the provisions of this section which, by their nature apply after termination.

 

Disclaimer of Warranty

Actutor disclaims all warranties, express or implied, with respect to our website, the services and each portion thereof, including, but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement or other violation of rights.

 

Actutor does not warrant or make any representations regarding the use, validity, accuracy, or reliability of, or the results of the use of, or otherwise respecting, Actutor content, the website, the services, each portion thereof or any third party websites.

 

Under no circumstances, including but not limited to, negligence, shall Actutor or third parties be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or of the use, or the inability to use, Actutor content, the website, the services, or the inability to use, Actutor content, the website, the services or any portion thereof, even if Actutor or authorized representative has been advised of the possibility of such damages. If the students use of the website, Actutor content, the services or any portion thereof results in the need for servicing, repair, or correction of equipment or date, students assume their own costs thereof.

 

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to the students. Neither Actutor, nor third parties warrant the accuracy or completeness of the information, text, graphics, links or other items contained in the Actutor content, the website, the services, or any portion thereof, or in any reports of verification services. Students agree not to hold Actutor (or agents, employees, tutors, officers, representatives, members) liable for any instruction, advice or services delivered which originated through the website, through any verification service or in connection with Actutor content, the services or any portion thereof.

 

Indemnification

The registered students agree to indemnify, defend and hold harmless all members, officers, directors, and associates, employees, and independent contractors of Actutor from and against all losses, expenses, damages, costs, claims and demands, including reasonable attorney’s fees and related costs and expenses, due to or arising out of any user content students submit, post to, email, or otherwise transmit to or through Actutor serives.

 

Actutor reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by students, and in such case, students agree to fully cooperate with such defense and in asserting any available defenses.

 

Trademark Notice

The trademarks, service marks, and logos used and displayed on the Actutor site are registered and unregistered Trademarks are protected, without limitation, pursuant to U.S. and foreign trademark laws. Nothing on the site, the Services or otherwise should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the site or in connection with Actutor Content or software, without the written permission of the applicable Trademark owner.

 

Actutor aggressively enforces our intellectual property rights to the fullest extent of the law. Students may not use the Trademarks, either Actutor or others, in any way without the prior written permission of the Trademark owner.

 

Copyrights

Actutor respects the intellectual property of others, and students are asked do the same. If students or independent contractor tutors believe that their work has been copied in a way that constitutes copyright infringement, or intellectual property rights have been otherwise violated, please inform us of such violations.

 

Local Laws, Export Control

Recognizing the global nature of the Internet, students agree to comply with all local rules including, without limitation, rules about the Internet, data or privacy. Specifically, students agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which the students reside.
